Chapter 13 Checklist The following documents are needed prior to filing your Chapter 13 case: - Copies of all pay statements received during the past six (6) months. If you are self-employed or otherwise do not receive pay statements, please provide copies of other documentation establishing your income.
- Copy of your Federal Income Tax Return. (All federal and state tax filings must be current.)
- A Certificate of Credit Counseling for each debtor from an approved credit counseling agency. The counseling can usually be done on-line or by telephone. You can find a list of approved agencies at www.utb.uscourts.gov under the "Credit Counseling/Debtor Education" box.
- Completed Creditor Worksheets.
- Completed Financial Worksheet.
You will also be required to submit copies of additional documents after your case has been filed, most usually at the meeting of creditors about a month later. Be prepared to provide the following: - Copies of all pay statements received since your case was filed.
- Copies of your bank statements(s) showing the balance in your account(s) as of the date of filing.
- If you own real property, a copy of your most recent mortgage statement(s) and tax notice.
- If you have a retirement account at work, or elsewhere, a copy of your most recent statement.
- Completed Debtor Questionnaire - If the trustee requires this document, a form will be mailed to you to fill out and sign prior to the meeting.
- You must present two (2) forms of identification at the meeting of creditors, at least one (1) of which shows your Social Security Number; your Driver's License and Social Security Card are the best choices, but other forms of I.D. are acceptable if they are original documents and were created by third parties.
